Is Elle TCPA compliant?

In 2015, FCC released a Ruling and Order concerning the Telephone Consumer Protection Act (TCPA) that immediately addressed text messaging and consumer protection. 

 

The TCPA rules and regulations state that written consent is required before sending any text message to a consumer's mobile phone. Written consent is also covered under the E-SIGN Act, which states that collecting prior consent includes electronic or digital forms of signature.

 

Shastic's text messaging platform, Elle, solves this by making sure to get the prospect's express consent before capturing any contact information or delivering any message, per TCPA guidelines. After clicking on the 'Chat With Us' button, the Financial Institution captures each member's consent to receive text messages. You will notice the compliance language and the pre-checked box aligns with TCPA rules and regulations.

 

When the member enters their name and mobile number, then clicks 'Let's Talk', a member will receive an automatic (RPA) text message from the FInancial Institution to prompt the member to ask a question. 

Additionally, Financial Institutions are attaching these Elle opt-in buttons to their 'Apply Now' buttons, for both web and mobile, across all loan products as well as new membership account call-to-action buttons.
