In 2015, FCC released a Ruling and Order concerning the Telephone Consumer Protection Act (TCPA) that immediately addressed text messaging and consumer protection.
The TCPA rules and regulations state that written consent is required before sending any text message to a consumer's mobile phone. Written consent is also covered under the E-SIGN Act, which states that collecting prior consent includes electronic or digital forms of signature.

When the member enters their name and mobile number, then clicks 'Let's Talk', a member will receive an automatic (RPA) text message from the FInancial Institution to prompt the member to ask a question.
Additionally, Financial Institutions are attaching these Elle opt-in buttons to their 'Apply Now' buttons, for both web and mobile, across all loan products as well as new membership account call-to-action buttons.
What's great about tying the Elle pop-up with both 'Apply Now' and 'New Member' buttons is how Elle provides a smooth re-direction into the Origination application platform, while also providing real-time tracking integration for both LOS and Member Origination systems.
